PRIVACY INFORMATION FOR CALIFORNIA RESIDENTS

1. Rights under the California Consumer Privacy Act

Wayfinder does not currently believe it is subject to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), because it does not presently meet the statutory thresholds for applicability. However, to the extent the CCPA applies to Wayfinder’s processing of personal information, California residents may have certain rights regarding their personal information, including rights of access, correction, deletion, and data portability, subject to applicable exceptions and limitations under law.

For clarity, where Wayfinder processes student information on behalf of educational institutions, such information may constitute “education records” subject to the Family Educational Rights and Privacy Act (“FERPA”) and is handled by Wayfinder as a service provider to schools in accordance with applicable contractual and legal requirements. In such cases, access to or amendment of student education records is governed by the relevant educational institution, not this CCPA section.

1.1 The Right to Know and Access Information

You may request that Wayfinder disclose the following information covering the 12-month period preceding your request: (i) the categories of personal information we have collected about you; (ii) the categories of sources from which such personal information is collected; (iii) the business or commercial purposes for collecting such personal information; (iv) the categories of third parties to whom we disclose personal information; and (v) the specific pieces of personal information we have collected about you.

1.2 Right to Deletion

You may request deletion of personal information we have collected from you, subject to certain exceptions under applicable law.

1.3 Right to Correction

You may request correction of inaccurate personal information we maintain about you.

1.4 Right to Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA, as prohibited by law.

Wayfinder does not sell or share personal information as those terms are defined under the CCPA, and has not sold or shared personal information in the preceding 12 months.

To exercise your rights, please contact us at privacy@projectwayfinder.com. We will take reasonable steps to verify your identity before responding to your request. You may also designate an authorized agent to submit a request on your behalf, as permitted under applicable law.

2. Rights under California’s “Shine the Light” Law

California’s “Shine the Light” law (California Civil Code Section 1798.83) permits California residents to request information regarding a business’s disclosure of certain personal information to third parties for their direct marketing purposes. Wayfinder does not disclose personal information to third parties for their own direct marketing purposes unless you affirmatively authorize such disclosure. Accordingly, pursuant to California Civil Code Section 1798.83(c)(2), Wayfinder is not required to provide such disclosures.
